Credit Cards

The majority of Credit Cards issued before April 2007 can be rendered unenforceable. Some Credit Cards where the application was signed on bank premises and some Internet applications do meet the criteria laid down by the Act in terms of signatures and may be enforceable but need to be examined to determine that all the prescribed terms are included. The application to have a Credit Card rendered unenforceable is straightforward.


Mortgages

Mortgages written before FSA M Day i.e. October 31st 2004 by a Broker using a Sub Prime lender can often be subject to a claim. Again the main offence we are looking for is secret commissions, but incorrect calculation of redemption figure or excessive exit


Financial Loans

The main reason loan agreements are declared unenforceable is because of the failure by the lender or the broker to inform the client of any commission paid by the lender to the broker. Excessive interest charges, incorrect calculation of the APR or incorrect statement of the amount of credit or cost of credit can also be the basis for claims.

Call us up on 01642 455231 or give us your number and we'll call you to discuss your loan agreement and tell you what you'll need to do next.

We will need from you your signed agreement that we can act on your behalf in auditing your loan. This also means that we need a copy of your loan agreement(s). If you don't have these you can obtain copies from the lenders for £1 per agreement. They are required to send you these within 14 days of receipt of your letter.

Once we have your paperwork we will undertake a free of charge audit on each agreement to establish whether or not there have been breaches of the requirements of the Consumer Credit Act 1974. We are normally able to do this within 72 hours .

We will then tell you whether or not your agreements are breached and how. If the irregularity has caused detriment to you we will appoint a specialist solicitor to pursue your claim against the lender(s). You will not have to pay any fees as the solicitors fees are recovered from the lender on the successful conclusion of your claim.

The case should be settled in around six months.
